WHY THIS NOTICE

This notice will let you know in detail how the personal data you provide us through filling up the form to enjoy the services offered by Arredamenti Martinel s.n.c. will be processed.

TYPOLOGY AND NATURE OF DATA TREATED

Completing the form on the website will be collected your personal data, or data that allow your identification, even indirect, such as name, surname, address, email, phone number, Fiscal Code, VAT number, or other data that you will release spontaneously in contacting us directly.

 

PURPOSES AND LEGAL LAWFULNESS BASIS FOR THE PROCESSING

Data collected will be used for the following purposes:

• allow you to create and manage your personal account in the e-commerce to use the services provided;

• manage supply contracts and their direct execution from the order untill the delivery (registration, choice of the product and cart, purchase, payment, shipment and delivery, withdrawal, manage of possible complaints), manage accounting invoicing operations, manage the relationships with you for any communication relating the supply contract and the collection of possible considerations and judgements;

• allow the release of information on your request;

• with your explicit consent, your email address will be processed to provide you with the company's newsletter service, that is, sending generalized promotional or advertising messages. At any time you can revoke your consent by requesting cancellation from the newsletter, by contacting directly the contact details indicated above.

Common nature data may also be processed without your specific consent and this to satisfy your requests and for the related pre-contractual and contractual and instrumental purposes to the service requested, as well as to comply with the related legal obligations to which the Data Controller is subject.

In order to receive only the Newsletter it is necessary to give the consent.

You are free to provide your data or not, but without the data required it will not be possible to conclude or execute the service and your requests.

 

MODE AND PLACE OF PROCESSING AND RETENTION PERIOD

The processing of your data takes place by our headquarters, using electronic, paper, or automated tools and is carried out by authorized and instructed parties within the limits of their assignment, for the time strictly necessary to achieve the purposes for which they have been collected.

Your data, in particular, will be kept for the duration of the contract and, thereafter, for the time necessary to fulfill tax obligations, or for other purposes provided by law or regulation (usually 10 years).

 

DATA COMMUNICATION AND DISTRIBUTION

Your personal data may be disclosed to the following subjects’ categories:

a) to our suppliers with whom we work, to give you the service required; 

b) to shipping companies and to companies that handle payments (PayPal, credit institutions, credit card companies)

c) to data processing and IT services companies, professionals, companies or consulting firms, companies providing services for the execution of the contract.

These subjects will act as autonomous Data Controller, or will be designated as Data Processors with a specific contract or legal act.

Data may also be accessed by subjects to whom this right is granted by provisions of law or regulations (eg public security authorities).

Data will not be subject of an automated decision-making process, nor will any profiling be carried out

Personal data will not be disseminated, nor will be transferred to third countries or international organizations.

If you will not exercise any active action (eg login with username and pw) for a period longer than 24 months, you will be classified as an inactive user and your personal data, which are not required for tax or legal purposes, will be deleted.

 

DATA SUBJECT’S RIGHT

Among the rights recognized are included:

• Ask for access to your personal data and to the information concerning them; the correction of any inaccurate data of the integration of incomplete data, the deletion of personal data (upon the occurrence of one of the conditions indicated in art. 17, paragraph 1 of the GDPR and in compliance with the exceptions mentioned in paragraph 3 of the same article); the restriction of processing of personal data (under one of the hypothesis indicated in art. 18 paragraph 1 of GDPR); 

• Apply for and receive – whereas the legal basis for the processing is the contract or the consent and it is done through automated devices – personal data in a structured format and readable from an automated device, also with the aim to communicate such data to another data processor (so called  right to data portability);

• oppose at any time to the processing of personal data to the occurrence of particular situations that concern him/her;

• withdraw the consent at any time, limited to the hypothesis in which the treatment is based on consent for one or more specific purposes and concernes common personal data (for example date and place of birth or place of residence), or particular data categories (for examples data concerning health or sexuality). The processing based on consent and done before the withdrawal keep its lawfulness;

If you think that there is a violation in the processing of personal data, you have the right to lodge a complaint with the Garante pursuant of the place where you live, work or where the possible violation has taken place. We inform you that in Italy you can lodge a complaint to the Data Processor by the Garante Authority.

We inform you that this privacy statement may be subject to changes and additions over time, which might be necessary with reference to new regulatory measures.
